Employing ROI Or GB Staff – Understand The Law

A leading employment law specialist with Belfast firm Millar McCall Wylie is urging Northern Ireland employers to ensure they fully understand the HR and legal implications of employing staff from ROI and GB in their workforce.

David Mitchell, Associate Director (NI & ROI) with Millar McCall Wylie, has highlighted that because employment law varies between Northern Ireland, Republic of Ireland and Great Britain, an employer could inadvertently find themselves in breach of employment rights by solely abiding by NI employment law.

“Local companies with either a physical presence in ROI or GB or employees in ROI or GB, have an increasingly complex HR landscape to navigate,” David Mitchell explains.

“It is really positive that technology and remote working have made it easier for local companies to employ people from outside NI. However, there is an employment and HR aspect to be aware of when you do.

“Employment law varies between jurisdictions, so a staff member working remotely from ROI, for example, may be subject to ROI employment law. Similarly, an employee working in GB for an NI company is likely to be subject to GB employment law. Employers can therefore inadvertently breach employment rights by solely applying Northern Ireland law,” David Mitchell said.

Millar McCall Wylie is hosting two upcoming events to inform and support HR professionals and business owners around the legal implications of cross-border and cross-jurisdictional employment.

“The two events we have planned in February will be informal, interactive sessions where I will outline the main areas that NI organisations employing ROI and GB staff should be aware of, as well as answer any questions attendees might have on the topic,” David Mitchell added.

‘Employing a Cross Border Workforce’ will take place at Millar McCall Wylie’s Belfast office in Imperial House. The first on 2nd February will focus on companies with an all-Ireland workforce and the second on 9th February will be of relevance to NI employers with employees based in GB.
